These terms and conditions are entered into by and between JMFitnessUK. (hereinafter: “JMFitness”) and You (hereinafter: “the Member”).
JM Fitness - 6 Week Transformation Challenge - Terms and Conditions and Agreement

The membership entitles you to access to the JMFitness venue, equipment, training program & coaching services available therein.
Membership:
The membership is personal, and cannot be shared.
Age Limit:
The Member confirms that she is 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on written parental consent. Persons under 16 years of age must be supervised at all times.
Payment:
TheMember is responsible for the payment of the membership. This is true even if the amount is debited directly by JMFitness. The agreed price only applies if the Member pays according to the agreed conditions.
Membership Duration:
The Member understands that her initial membership will last for a total of 6 weeks from the start date.
All new challenge memberships are subject to a minimum term of 42 days. The first payment or pro-rata amount and any sign-up fees are paid at the point of this agreement. When paying in a two-way split, the following payment should be paid on or before the end of the third week. Payments are taken automatically via Stripe. The member is responsible for all payments, also in the case of automatic debits by JMFitness.
If the payment is late the Member will receive a reminder email from JMFitness and access may be suspended. The membership continues to run even if the access is suspended. If after 30 days the amount is still not paid, the Member is in violation of the contract and the total outstanding amount of the contract will be due. JMFitness may transfer the case to a debt collector, which will add additional fees.
The Member has given approval for an automatic debit from her account or card and cancellations must be requested in TeamUp with a minimum of 60 days notice required.
Rescheduling / Missed Sessions:
The Member understands that missed sessions do NOT carry over into the next week or phase, and that she is responsible for attending all of JMFitness' sessions.
Satisfaction Guarantee:
For 7 days from the start of the membership, the Member can cancel her membership free of charge and will be reimbursed in full.
Renewal & Cancellation:
The contract runs for a minimum of 42 days, during which time it cannot be cancelled. At the end of the contract period, the Member understands that upon successful completion of the program, should she choose to remain a member, a place in another program is not guaranteed, but she will be given priority over someone new. JMFitness will send reminder emails before the end of the contract period.
The Member understands that upon accepting a limited place on the program there is no refund policy (i.e., if she chooses not to take her place on the program before or after the commencement date, it is not refundable)
Exceptional cancellation - a 30-day cancellation is exceptionally granted if the Member moves more than ten kilometres away from any JMFitness venue, on presentation of an official document to prove a change of address. It is also possible to cancel the membership due to medical reasons, upon presentation of a medical certificate or loss of job upon presentation of an official document.
Health:
The Member confirms that she does not suffer from health problems that would hinder exercise or prevent her from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if she did exercise. In case of any doubt, the Member shall seek advice from a medical doctor who should confirm the ability to exercise.
JMFitness shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done by JMFitness, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a programme and not for diagnostic purposes.
Doctor Approval:
The Member confirms that she has represented to JMFitness that she has either a) been given a doctor’s permission to participate in the Training, or b) will voluntarily participate in the Training and all risks related to the Training without the approval of her doctor(s). She represents that she is not aware of any medical or physical conditions that would prevent her from participating in the Training or from using equipment or facilities, which pose a serious health risk to her. She further acknowledges that JMFitness has relied on her statements as being accurate and complete, as a condition of entering into this Agreement. She further acknowledges and agrees that she is not obligated to participate in any Training that she does not wish to participate in. She will inform the JMFitness immediately if she does not wish to participate in any specific Training.
Liability:
Each Member of JMFitness shall be liable for any property damage and/or personal injury caused by the Member on the JMFitness venue. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.
Waiver of Liability:
Any and all use of the JMFitness venue (online or in-person) shall be at Member’s own risk at all times. The Member shall not utilise any equipment unless she knows the appropriate usage. JMFitness shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.
Name And Likeness Release:
The Member understands that Trainer may photograph or video her prior to, during the delivery of, or at the completion of Training and she agrees to allow Trainer to use photographs and videos of her, as well as name and likeness for promotional purposes.
Personal Belongings:
The Member is responsible for their own personal belongings.
Lost Property or Theft:
JMFitness does not take responsibility for the loss, damage or theft of any personal belongings. Any items left at the JMFitness venue will be kept for a period of two weeks before being disposed of.
Code of Conduct:
The Member shall respect the behavioural and operating principles of JMFitness, as laid out in our operating procedures & code of conduct.
Suspension/Termination of Membership:
If the Member behaves in a way that breaches the code of conduct, membership can be suspended or terminated at Trainer’s sole discretion.
Access & Security:
JMFitness is open Monday to Saturday, with the exception of bank holidays and exceptional circumstances, when times may vary. Classes are available according to the times stated in the JMFitness booking system (TeamUp). Classes must be booked in advance. Classes and instructors are subject to change with no prior notice.
Business Interruption:
In the event that a JMFitness venue is inaccessible due to an interruption to business, a full schedule of Outdoor, Live Online and/or recorded on-demand sessions & content will be made available to all members.
